Definitions:

Client means the parent or legal guardian who places an order for early education photography services.

Booking and Payment:

All bookings must be made in advance. Full payment is required prior to photography. Services are delivered only on scheduled photo days.

Cancellation:

Cancellations more than six (6) calendar days prior to the photo day receive a full refund. Cancellations within six (6) days are non‑refundable.

Copyright and Ownership:

All images remain the exclusive property of von Maedler Photography. Copyright is retained under the Copyright Act 1968 (Cth).

Licence to Client:

The Client is granted a non‑exclusive, non‑transferable licence for personal, private use only. Images must not be sold, altered, or used commercially without written permission.

Social Media:

Once images are shared online, the Client assumes full responsibility. Images must not be altered, filtered, or used in a defamatory or misleading manner.

Failure to Perform:

If services cannot be delivered due to circumstances beyond reasonable control, the Photographer may reschedule or refund all monies paid. This refund is the Client’s sole remedy.

Liability:

To the fullest extent permitted by law, von Maedler Photography is not liable for injury, loss, or damage except where caused by proven negligence. Nothing in this Agreement excludes rights under Australian Consumer Law.

Image Resolution:

Images are supplied at high resolution suitable for printing unless otherwise stated.

Archiving:

Files are retained for up to two (2) years. Retrieval requests after six (6) months incur a $150 fee. Retrieval is not guaranteed.

Artistic Discretion:

All images are captured and edited at the Photographer’s discretion.

Editing:

Standard editing is included. Additional editing is charged at $35 per image.

Clothing and Consent:

Clients are responsible for appropriate clothing. Photography proceeds only with the child’s assent.

Communication:

All communication must be in writing (email or text message) at least 48 hours prior to the session.
